    Separate property is typically any asset or debt acquired before a marriage, received as a gift, or inherited. Property may also be named as separate in a marital agreement. In cases where the classification of an asset is contested, it may become necessary to “trace” the source of said asset to prove it is truly separate property.

    While a marital agreement can be a helpful tool in the case of a divorce, a signed document doesn’t guarantee its enforceability.
